I always er on the side of caution. I'd rather a few murders slip thru the cracks of a lawful trespassing claim than anyone be killed because they couldn't defend against an unlawful trespasser. Same as I believe in innocent until proven guilty. Rather a few guilties go free than any innocent get locked up. Which still happens, unfortunately.

I've always said I'd rather a few guilties walk free than one innocent get locked up...but by that same logic I'd rather someone get away with trespassing than an innocent person killed because someone thought they were trespassing

I don't have any problem with you pointing a gun at a trespasser

It's pretty hard to accidentally trespass. You either are or you aren't. To me the person who owns the property is the innocent party so I'd rather an accidental trespasser be murdered than a property owner be murdered because they aren't allowed to defend themselves when a trespasser with bad intentions trespasses.

Writing laws is always a fine line though. They'll never be perfect.

Do you think laws need to be more black and white or should juries/judges have more freedom of interpretation, Smark?

Oh they can be carrying that heat but I’ll still shoot them, they won’t see it coming. Pop pop!

I see benefits and criticisms of both, I like black and white stuff obviously bc it's easier but I also think it's not realistic at all and things should definitely be heard on a case by case basis. Like for this example, if a trespasser gets show...I think you can look at each situation and say whether or not deadly force should have been used or not because in some cases it will be very obviously that it should or shouldn't have been one way or another

I'm fine with jury interpretation to a point. And it depends on what the laws is I suppose.

So you think how we interpret laws is also open to interpretation depending on the law?

I agree but I think that answers why Americans can't ever agree on anything

It's really hard to answer without examples.
