Oh, if the investigation finds something potentially criminal and presses charges, then it gives her lawsuit a lot of weight. Remember people:

For Criminal Trials: Guilty beyond a reasonable doubt.

For civil trials, on a balance of probabilities (50% + 1).

So let's say the investigation presses charges but he is acquitted. If they basically find it was like "85% chance he did it" then he'd not get thrown in jail, but they'll probably have an easier time meeting the burden for a civil trial with the evidence likely out there.
