Two different scenarios. Debra signed legal papers (gag order) that kept her from speaking about the issue. By what Ashley has said, she was only advised, by word-of-mouth, to stay quiet. She's also someone who asked for her release to take care of her sick daughter mind you.
Also WWE wanted Debra to stay quiet about the whole domestic violence shit so them telling her to stay quiet is still believable.
If this allegation is true, and if WWE really did know then they can be at fault, but I think the negligence part makes no sense. Not sure what WWE could've done as her employer, other than treat her medically, which I don't think WWE denied to do for her. They can be at fault for putting her at risk, but from what I understand, WWE"s trips to the mid-east are completely voluntary, another piece of evidence that can be crucial. Unless she was contractually obligated, WWE knew, forcefully stopped her from going public about this or denied her help, I don't think the case has a big chance of winning. But this is all speculation, since I'm probably missing 9/10 of the facts she has.
