I got a larceny charge dropped due to the same thing except instead of not paying the $21ish for the case I got the ticket for a stack of CD-Rs.. and if she did forget for whatever reason human's make mistakes and none of you talking shit can say other wise :/

I've done this before on pure accident. Sometimes you put things through to scan and they don't scan properly. I noticed eventually but I can see if you're getting a ton of stuff how you might miss it.
