The thing about Flay being the Rolecop is, he knew Smarks alignment and someone proved that Odo doesn't tell scum teams their targets alignments in the Rolecop result. So there's two ways Flay is scum here, 1. if he legitimately took a stab at Smarks alignment and came up golden, or 2. if he's not just the Rolecop but maybe some other role as well.

I remember that one game where I was the scum Traitor+Cop who was supposed to find his own teammates with those Cop shots.

Because he fucked up an investigation result. Odo never clarified what it was, only that he fucked up. That doesn't clear him of *not* being the Role Cop. It only means that Flay got the wrong result.
