That Mistico is owned by cmll thus the name and mask being used still there, much like as in Cara has been used in wwe. If he jumped to aaa, I'm sure he would say he owned their character too

Copyright/Trademark laws always favor the individual (or company) that trademarked/patented the idea first, not who actually came up with it first. Therefore, if Cara didn't own his shit on paper before WWE thought to do it, sad news for him.

How do I know this? Let's just say, I've had to scrap some novel ideas...even though I wrote it first.
